Abstract

The 1997 Criminal Law of the People’s Republic of China established provisions covering trafficking offenses involving firearms, cultural relics, wildlife, human beings, and drugs, including aggravated penalties that, in certain circumstances, allow for the death penalty. Over the more than two decades since its enactment, ten amendments have been adopted to reform and readjust the Criminal Law in accordance with the objectives of safeguarding social harmony, protecting human rights, and implementing a criminal policy that combines severity with leniency, while also responding to emerging international trends. In addition, the Supreme People’s Court of China has sought to guide and harmonize the application of criminal law and criminal policy within its jurisdiction through the issuance of judicial interpretations.
